Uploading to Myspace?

Hey guys, I was just wondering about the legality of uploading a recording I did on When Sunny Gets Blue. theres no backing track, its just me, but im not sure if uploading it is legal or not, as I dont have ownership of the actual music(duh). Its basically a cover, and I find the terms of use to be pretty fuzzy. Thanks,

Basically, if it's not sold on some album somewhere, you can upload it.

If it's you playing, you can definitely upload it.
